POPIA Notice

1. Purpose of this notice
This notice is issued in terms of the Protection of Personal Information Act, 4 of 2013 ("POPIA"). It explains how VisaAxis processes your personal information as a responsible party.

3. Categories of personal information
In the course of providing immigration services, we process:
- Identifying information (name, nationality, ID/passport number, date of birth)
- Contact information (email, phone, address)
- Family information (spouse, dependants, marital status)
- Employment, education, qualifications and financial information
- Immigration history and supporting documentation
- Special personal information where strictly necessary (e.g. health records for medical treatment visas, criminal record clearances)
4. Conditions for lawful processing
We process your personal information in accordance with the eight conditions for lawful processing set out in POPIA: accountability, processing limitation, purpose specification, further processing limitation, information quality, openness, security safeguards, and data subject participation.
5. Consent
Where consent is required, by submitting our enquiry form or providing personal information to us, you voluntarily and expressly consent to the processing of your personal information for the purposes set out in this notice and our Privacy Policy. You may withdraw your consent at any time by writing to us, subject to any legal or contractual restrictions on doing so.
6. Cross-border transfers
Where your matter requires it (for example, communication with a foreign embassy or a relocation service provider abroad), your personal information may be transferred outside South Africa. We will only do so where the recipient is subject to laws, binding rules or agreements that provide an adequate level of protection.
7. Operators
We may engage third-party operators (e.g. cloud hosting, document management, secure email) to process personal information on our behalf. Each operator is bound by written agreement to maintain appropriate security safeguards and to process information only on our instructions.
8. Your rights as a data subject
Under POPIA you have the right to:
- Be notified that your personal information is being collected
- Request confirmation of, and access to, the personal information we hold
- Request correction or deletion of personal information that is inaccurate, irrelevant, excessive, out of date, misleading or obtained unlawfully
- Object, on reasonable grounds, to the processing of your personal information
- Lodge a complaint with the Information Regulator
9. Security compromises
In the event of a security compromise that affects your personal information, we will notify you and the Information Regulator as soon as reasonably possible in accordance with section 22 of POPIA.
